Terms and conditions of Head Spa Enschede, located at Zonstraat 36, 7521 HH Enschede, registered in the trade register under number 84391693.

1. Definitions
In these terms and conditions, the following definitions apply:
- Treatment: all treatments performed by Head Spa Enschede.
- Agreement: agreements (including verbal) concluded between Head Spa Enschede and a client.
- Client: the person to whom the agreement applies (the principal).
- Head Spa Enschede: Head Spa Enschede, located at Zonstraat 36, 7521 HH Enschede, registered in the trade register under number 84391693 (the contractor); and its employees.
2. Applicability
These terms apply to all agreements between Head Spa Enschede and the client. If any provision of these terms is found to be void or nullified, the remaining provisions remain in effect.
Head Spa Enschede reserves the right to amend these terms. Amendments will be communicated to the client in writing (by email) or electronically via www.headspaenschede.nl. Amendments take effect one month after the date of notification, unless stated otherwise in the notification.
If the client does not raise a reasoned objection within one month of the notification date, the client is deemed to have accepted the amendments. Dutch law exclusively governs this agreement.
3. Products
Products purchased from Head Spa Enschede cannot be returned or exchanged under any circumstances once the packaging has been opened.
Products in unopened packaging may be returned within two weeks of purchase, accompanied by the purchase receipt. In the event of a return, Head Spa Enschede will issue a credit note for the amount spent by the client. The credit note can be used for products and treatments offered by Head Spa Enschede.
4. Duty to inform
The client shall provide Head Spa Enschede, to the best of their knowledge, with the information and cooperation reasonably required to fulfil the agreement, and shall follow the advice of Head Spa Enschede.
The client shall truthfully complete the intake form of Head Spa Enschede and mention all relevant medical conditions and any medication they use.
5. Consent
Prior to the start of the treatment, the client grants unconditional and unreserved consent to the execution of the treatment by Head Spa Enschede by completing and signing the intake form.
The client grants unconditional and unreserved consent, in view of due care and privacy guidelines, to the registration of personal data and medical data relevant to the execution of the agreement.
6. The agreement
A client enters into an agreement with Head Spa Enschede. Employees of Head Spa Enschede are never a contracting party to the client.
Head Spa Enschede is entitled to refuse an unreasonable request from the client and may decline to perform a treatment.
If during the execution of an agreement it appears that modification or supplementation of the treatment is necessary for a good outcome, the parties will consult on this. Additional treatments incur extra costs.
Head Spa Enschede has the right to dissolve, terminate or suspend the agreement if:
- the client behaves improperly or disrespectfully towards Head Spa Enschede;
- the client has not met the payment conditions prior to the treatment;
- circumstances arise that are of such a nature that fulfilment of the obligations arising from the agreement cannot reasonably be expected of Head Spa Enschede.
7. Cancellation and no-show
If a client is unable to attend, the client may notify Head Spa Enschede no later than 24 hours before the appointment. In the event of a late cancellation or no-show, Head Spa Enschede may charge the full or partial fee for the treatment. If the client holds a package, Head Spa Enschede will deduct one treatment from the package.
Appointments can only be cancelled by phone via 06 14 87 43 81 or by email at info@headspaenschede.nl to be cancelled. Cancellation via WhatsApp, Instagram or other social media is not possible.
Head Spa Enschede may cancel or reschedule an appointment. The client will be informed as soon as possible.
8. Payment
The client must pay a deposit of € 20.00 at the time of booking, unless the client holds a gift voucher from Head Spa Enschede. The deposit will be deducted from the treatment fee. Refund of the deposit in the event of cancellation or rescheduling by the client is excluded. In that case, the deposit applies to the new appointment.
The client must pay the treatment fee directly after the treatment, in cash or by card. Treatment packages may be paid in three or four instalments. A treatment package consists of six treatments. The instalments must be paid during the first three or four treatments of the package respectively.
The client may pay for the treatment with a gift voucher from Head Spa Enschede, purchased for a specific amount or for a specific treatment. Gift vouchers are transferable and may be used by the recipient or another person. Gift vouchers are valid for 24 months. After this period they expire. The expiry date is stated on the gift voucher itself. Gift vouchers cannot be exchanged for cash, except where required by law.
The client will receive a digital invoice after the treatment. In the event of late or incomplete payment, the client is immediately in default without notice. Head Spa Enschede is then entitled to charge statutory interest and to take collection measures.
9. Rates
Rates apply, unless explicitly agreed otherwise in writing, for the duration of the calendar year and may be adjusted annually.
10. Liability
The liability of Head Spa Enschede is limited to the amount covered by its insurance. If the insurer does not pay out in a given case, or the damage is not covered by the insurance, liability is limited to the invoice amount of the relevant treatment.
Head Spa Enschede is not liable for damage caused by circumstances attributable to the client, such as incorrect or incomplete information or failure to follow advice and instructions.
All treatments constitute a best-efforts obligation and not an obligation of result. No guarantee can therefore be given as to the outcome.
11. Complaints
Complaints must be submitted by the client within six weeks of the treatment by email via info@headspaenschede.nl to Head Spa Enschede. After this period, complaints will no longer be processed.
A complaint does not suspend the client's payment obligation, unless Head Spa Enschede agrees otherwise. The parties will only appeal to a court and/or complaints or dispute resolution body after having made efforts to resolve the dispute through mutual consultation.
